Pro Content License

This license forms part of the margheritaAI Content License Agreement (CLA) and applies in addition to its general terms. In the event of conflict, the provisions of this license prevail for Pro Content.

1. What Pro Content is

„Pro Content" means all margheritaAI content that is reserved for paying subscribers and is labelled accordingly in the service interface (e.g. by a Pro symbol). This includes, for example, high-quality photos, shapes, graphics, illustrations, icons, fonts and templates.

All Pro Content is created by margheritaAI itself using generative AI tools. For the nature of this content, see Section 5.

2. Prerequisite: an active subscription

Use of Pro Content requires an active, paid margheritaAI subscription. As long as your subscription is active, the following applies to you.

3. Your license

We grant you a non-exclusive, worldwide right to use the Pro Content for the permitted uses set out below (the „Pro Content License"), for as long as your subscription exists. We thereby grant you a right of use, but do not guarantee you any copyright protection or exclusivity in the Pro Content (see Section 5 and Section 4B of the CLA).

4. What you may do with Pro Content

With an active subscription, you may use Pro Content:

• for private and commercial projects
• in an unlimited number of designs, without having to purchase a separate license per use – your subscription covers all permitted uses
• in products and printed materials that you create or sell, provided the Pro Content forms part of a standalone design
• by incorporating it into finished designs and handing those to your customers
• exporting and downloading it without a watermark, as long as your subscription is active
• by incorporating it into templates that you share or sell via a shared link provided by margheritaAI (see Section 6)

5. Nature of the Pro Content (AI-generated content)

The Pro Content is created using generative AI tools. The notes in Section 4B of the CLA apply: in particular, such content may be protectable by copyright only to a limited extent, we do not guarantee you any exclusivity, and identical or similar content may also be available to others. If you seek stronger legal protection, make your own creative modifications.

6. Watermarks and templates

Watermark-free export. As long as your Pro subscription is active, you can export and download designs containing Pro Content without a watermark. If your subscription ends, Pro Content is immediately watermarked again on every re-export – including in designs you created earlier while subscribed (see Section 8).

Template sharing. You may share or sell designs containing Pro Content as a template via a shared link provided by margheritaAI. The recipient does not thereby acquire any independent right to the included Pro Content. When they open the template, the licensing rules apply again: without their own active Pro subscription, the Pro Content is watermarked on export. Distributing Pro-Content templates as a loose file outside the service in order to circumvent this rule is not permitted.

7. What you may not do

• resell, redistribute or license the Pro Content unchanged as a standalone element – it must always form part of a design created by you
• claim that you are the author of the Pro Content itself
• use the Pro Content unlawfully, misleadingly, defamatorily or otherwise in a manner that violates the CLA

8. What applies after the subscription ends

If your Pro subscription ends, you lose access to Pro Content for new designs. Files you already exported without a watermark during an active subscription may continue to be used within the permitted uses. However, if after the end of the subscription you re-export a design that contains Pro Content – including one created earlier – the Pro Content is watermarked in the process. Watermark-free use is only possible again after entering into a new active Pro subscription.

9. Identifiable persons and brands

If an element shows an identifiable person, place, logo or brand, check on your own responsibility before use – especially commercial use – whether additional permissions are required.

10. Relationship to the CLA

All matters not expressly governed by this Pro Content License are governed by the CLA, including the provisions on liability, termination, changes and applicable law.
